Witch and The Water Planet Privacy Policy

PASTEL ORBIT (“Developer”) handles information collected through “Witch and The Water Planet” (“App”) in accordance with this Privacy Policy.

1. Information We Collect

Game Service Information

The App may collect the following information to the extent necessary to provide and operate the service:

The user identifier is independently generated by the App and is not a device-specific identifier.

This information may be used to manage game data, provide friend features, deliver in-app messages from the server, and provide other functions of the App.

The App does not require users to provide information such as their name, postal address, or telephone number in order to play the game.

Paid Crystal Balances

Paid Crystal balances are not stored on the Developer’s servers and are stored only on the device on which they are used.

Paid Crystal balances are managed separately for the iOS, Android, and Steam versions of the App and cannot be shared or transferred between these platforms.

If the App is uninstalled, Paid Crystal balances stored on the device will be deleted and, in principle, cannot be restored.

Purchase Information

For the purposes of verifying purchases, managing purchase status, and preventing fraudulent use, the App may collect and transmit the following information to the service server:

The current balance of Paid Crystals itself is not stored on the service server.

Payments are processed through the Apple App Store, Google Play, Steam, or another platform through which the App is distributed.

The Developer does not directly collect or store credit card numbers, bank account numbers, or other payment method information.

Error and Crash Information

For troubleshooting and improving the quality of the App, the following information may be automatically collected and transmitted to the service server when an error or crash occurs:

Device-specific identifiers, names, email addresses, and similar information are not collected as part of crash diagnostics.

User identifiers, certain game data, and purchase-related transaction information required to provide the service may be retained on the service server for as long as reasonably necessary to provide and operate the service.

When the service is discontinued, a deletion request is received, or the relevant information is otherwise no longer necessary, such information will be deleted within a reasonable period, except where continued retention is required by law or reasonably necessary for purposes such as fraud prevention or maintaining transaction records.

Error and crash information is retained only for as long as reasonably necessary for troubleshooting and service quality improvement and will be deleted when it is no longer required.

Paid Crystal balances are not stored on the service server.

4. Disclosure and Sharing of Information

The Developer does not use collected information for purposes other than those described in this Privacy Policy or disclose such information to third parties without the user’s consent, except in the following circumstances:

7. Data Deletion Requests

If you wish to request deletion of your user identifier and related game data stored on the service server, please contact the Developer at the email address above.

You may be asked to provide your in-app user identifier or other information necessary to confirm that the requested data belongs to you.

After the request has been verified, the relevant information will be deleted within a reasonable period, except where continued retention is required by law or reasonably necessary for purposes such as fraud prevention or maintaining transaction records.

Please note that Paid Crystal balances are stored only on the user’s device and are not stored on the service server.

8. Changes to This Privacy Policy

This Privacy Policy may be revised as necessary due to changes in applicable laws, changes to the App’s functionality, changes to the method of service operation, or other circumstances.

If material changes are made, users will be informed through the App, the Developer’s website, or another appropriate method.

9. Scope

This Privacy Policy applies to the iOS, Android, and Steam versions of the App and related services provided by the Developer.

「水の星と魔女」利用規約(Japanese)

本利用規約（以下「本規約」といいます）は、PASTEL ORBIT（以下「当方」といいます）が提供する「水の星と魔女」（海外名：Witch and The Water Planet。以下「本アプリ」といいます）の利用条件を定めるものです。

ユーザーは、本アプリを利用することにより、本規約に同意したものとみなされます。

未成年者が本アプリを利用する場合は、親権者その他の法定代理人の同意を得た上で利用してください。

第1条　本アプリの利用

当方は、ユーザーに対して、本規約に従うことを条件として、本アプリを個人的かつ非営利目的で利用する権利を許諾します。

ユーザーは、本アプリの利用に必要となる端末、PC、通信環境その他の設備を、自己の責任と費用において用意するものとします。

第2条　権利の帰属

本アプリを構成するプログラム、画像、イラスト、キャラクター、文章、シナリオ、音楽、音声、映像、デザイン、ユーザーインターフェース、名称、ロゴ、商標その他のコンテンツに関する著作権、商標権その他の権利は、当方または正当な権利を有する第三者に帰属します。

ユーザーは、法令上認められる場合を除き、これらを無断で複製、転載、改変、配布、販売その他の方法により利用してはなりません。

第3条　ユーザー識別子およびゲームデータ

  1. 本アプリは、初回起動時等に、ユーザーを識別するための独自のユーザー識別子を自動的に生成する場合があります。
  2. ユーザー識別子は、フレンド機能、ゲームデータの管理、サーバーからのアプリ内メッセージの送信その他本アプリの機能を提供するために利用されます。
  3. 本アプリのゲームデータは、主としてユーザーの端末内に保存されます。一部のゲームデータ、ユーザー識別子および購入に関する情報等については、当方のサーバーにも保存されます。
  4. 端末内にのみ保存されているデータは、本アプリのアンインストール、端末の故障、初期化、機種変更、OSの変更その他の事情により消失する場合があります。

第4条　ゲーム内通貨「クリスタル」

  1. 当方は、本アプリ内において、ゲーム内通貨「クリスタル」を提供することがあります。
  2. 現実の通貨を対価として購入するクリスタルを「有償クリスタル」といいます。
  3. 有償クリスタルは、Apple App Store、Google Play、Steamその他当方が指定するプラットフォームの決済システムを通じて購入できます。
  4. 購入価格、購入単位その他の条件は、本アプリ内または各プラットフォームの購入画面に表示します。
  5. 有償クリスタルの残高は、当方のサーバーには保存されず、ユーザーが利用している端末内にのみ保存されます。
  6. iOS版、Android版およびSteam版で取得または購入したクリスタルは、それぞれ独立して管理され、異なるプラットフォーム間で残高を共有または移行することはできません。
  7. 有償クリスタルは、原則として別の端末へ移行することはできません。ただし、当方が別途移行手段を提供する場合を除きます。
  8. 本アプリをアンインストールした場合、端末内に保存された有償クリスタルの残高は消失します。
  9. ユーザーは、クリスタルを第三者へ譲渡、貸与、販売その他の方法により移転することはできません。
  10. クリスタルを現金その他の通貨に交換することはできません。
  11. 購入確定後のユーザー都合による返品、交換、キャンセルまたは払戻しは原則として受け付けません。ただし、法令またはApple App Store、Google Play、Steamその他利用するプラットフォームの定めにより払戻し等が認められる場合を除きます。
  12. 本サービスの終了その他の事情により法令上払戻しその他の対応が必要となる場合には、当方は法令に従って対応します。

第5条　ゲームデータおよびクリスタルの消失

  1. 本アプリのアンインストール、端末またはPCの故障、紛失、初期化、機種変更、ストレージの消去その他の事情により、端末内に保存されたゲームデータおよびクリスタルが消失する場合があります。
  2. 特に、有償クリスタルの残高はサーバーには保存されないため、本アプリをアンインストールすると残高は消失し、原則として復旧できません。
  3. 当方は、ゲームデータまたは有償クリスタルについて、完全な保存、復旧または端末間・プラットフォーム間での移行を保証するものではありません。
  4. 当方の責めに帰すべき事由がなくデータ等が消失した場合、当方はその復旧または補償を行う義務を負いません。
  5. 当方の責めに帰すべき事由により損害が生じた場合については、第12条の定めに従います。

第6条　禁止事項

ユーザーは、以下の行為を行ってはなりません。

  1. 法令または公序良俗に違反する行為
  2. 本規約に違反する行為
  3. 本アプリまたはサーバーへの不正アクセス
  4. 本アプリの不正な改変、解析またはリバースエンジニアリング
  5. チートツール、自動操作ツールその他当方が認めていない手段の利用
  6. 不具合、脆弱性または想定外の挙動を意図的に利用する行為
  7. ゲームデータ、ユーザー識別子、クリスタル等を不正に生成または改変する行為
  8. ゲームデータ、クリスタル等を現実の通貨その他の対価と交換する行為
  9. 他のユーザーになりすます行為
  10. 他のユーザーに対する嫌がらせ、脅迫、誹謗中傷その他迷惑となる行為
  11. フレンド機能その他のユーザー間機能を本来の目的に反して利用する行為
  12. 当方または第三者の権利を侵害する行為
  13. 本アプリまたはサービスの運営を妨害する行為
  14. その他、当方が合理的な理由に基づき不適切と判断する行為

第7条　利用停止等

ユーザーが本規約に違反した場合、不正利用を行った場合その他本アプリの運営に重大な支障を及ぼした場合、当方は必要かつ合理的な範囲で、本アプリの利用制限、ユーザー識別子の停止、不正に取得されたデータの修正または削除その他必要な措置を行うことがあります。

第8条　サービスの変更、停止および終了

当方は、本アプリの品質向上、仕様変更、メンテナンス、障害対応その他運営上必要な場合、本サービスの全部または一部を変更または一時停止することがあります。

当方は、本サービスの全部または一部を終了することがあります。

サービスを終了する場合、緊急その他やむを得ない場合を除き、本アプリ、公式ウェブサイトその他適切な方法により事前に告知するよう努めます。

有償クリスタルその他について法令上の払戻し等が必要となる場合には、法令に従って対応します。

第9条　プライバシーおよびお問い合わせ

本アプリにおける情報の取扱いについては、当方が別途定める「水の星と魔女 プライバシーポリシー」に従います。

第10条　第三者サービス

本アプリでは、Apple App Store、Google Play、Steamその他第三者が提供するサービスを利用する場合があります。

これらのサービスについては、それぞれのサービス提供者が定める利用条件等が適用される場合があります。

第11条　保証の範囲

当方は、本アプリについて、可能な範囲で安定したサービスの提供および不具合の改善に努めます。

ただし、不具合が一切発生しないこと、すべての端末、PCまたはOSで動作すること、将来にわたって永続的に提供されることその他一切を保証するものではありません。

第12条　損害賠償および責任の制限

ユーザーが故意または過失により本規約または法令に違反し、当方に損害を与えた場合、ユーザーは当該行為と相当因果関係のある範囲で生じた損害を賠償する責任を負います。

当方の責めに帰すべき事由によりユーザーに損害が生じた場合、当方は法令に従って責任を負います。

当方の故意または重大な過失による場合を除き、適用される法令で認められる範囲において、当方が負う損害賠償責任は、ユーザーに現実に生じた通常かつ直接の損害に限るものとします。

法令上、責任の免除または制限が認められない場合には、本条の責任制限は適用されません。

第13条　本規約の変更

当方は、法令の変更、本アプリの内容または運営方法の変更その他合理的な必要がある場合、本規約を変更することがあります。

変更する場合は、変更内容および適用時期について、本アプリ、公式ウェブサイトその他適切な方法により周知します。

第14条　分離可能性

本規約の一部が法令等により無効または執行不能と判断された場合でも、その他の規定は引き続き有効に存続します。

第15条　準拠法および管轄

本規約および本アプリの利用には日本法を適用します。

本規約または本アプリについて紛争が生じた場合、当方とユーザーはまず誠実に協議して解決を図るものとします。

協議によって解決しない場合には、法令に別段の定めがある場合を除き、当方の所在地を管轄する地方裁判所または簡易裁判所を第一審の合意管轄裁判所とします。

第16条　言語

本規約は日本語版を正文とします。

翻訳版と日本語版との間に内容または解釈の相違がある場合には、法令に別段の定めがある場合を除き、日本語版を優先します。
